Probate Process


The probate process is a court-supervised procedure designed to facilitate the orderly transfer of assets from the deceased individual's name to their rightful legal heirs or designated beneficiaries. In addition to ensuring the proper distribution of assets, probate serves several crucial purposes. It validates the authenticity and validity of a will, appoints an executor or personal representative to oversee the estate administration, conducts an inventory and appraisal of the deceased's property, settles outstanding debts and taxes owed by the deceased, and ultimately distributes the estate assets according to the instructions outlined in the will or in accordance with state laws if there is no will. Through probate, the court provides a framework to safeguard the interests of all parties involved and ensure a fair and orderly distribution of the deceased's estate.
